These terms govern your use of the PulseArc website, platform, and related services.

These terms apply to visitors to pulsearchealth.online and to organisations engaging PulseArc Health Technologies ("PulseArc") for platform access, subscription services, or implementation services.

1. Website use

You may use the website for lawful information and enquiry purposes. You must not interfere with the operation, security, or content of the website.

2. Platform enquiries

Requests for information, demos, or proposals are treated as commercial enquiries and do not create a contractual relationship until documented in a signed agreement.

3. Account access

Access to platform environments is granted under the terms of the applicable order form, service agreement, or contract. Access is restricted to authorised users.

4. Customer responsibilities

  • Managing user access, permissions, and role assignments for its authorised users.
  • Ensuring information uploaded to the platform is accurate, lawful, and appropriately consented to.
  • Compliance with all applicable healthcare, privacy, and payment regulations relevant to its operations.

5. Acceptable use

Use of the platform is subject to the Acceptable Use Policy.

6. Intellectual property

All PulseArc software, documentation, and branding remain the property of PulseArc. Customers receive a limited, non-transferable right to use the platform in accordance with their agreement.

7. Third-party systems

Integrations with third-party systems are subject to the terms of those third parties. PulseArc is not responsible for the performance or availability of third-party services.

8. Payment terms

Fees, billing frequency, currency, and payment methods are set out in the applicable order form. Payments are processed through approved payment providers.

9. Subscription terms

Subscription duration, renewals, and cancellation rights are specified in the applicable order form.

10. Implementation services

Implementation services are delivered based on an agreed scope. Timelines depend on customer readiness, third-party systems, approvals, testing, and integration complexity.

11. Service availability

PulseArc uses reasonable measures to maintain platform availability. Planned maintenance and events outside PulseArc's reasonable control may affect availability.

12. Data responsibilities

Customers control the healthcare and operational data they process through the platform. PulseArc processes such data on the customer's behalf under the applicable agreement.

13. Confidentiality

Each party will protect the other's confidential information and use it only for purposes of the applicable agreement.

14. Security responsibilities

PulseArc maintains platform security controls; customers are responsible for user access, credential protection, and configuration decisions within their environment.

15. Limitation of liability

To the maximum extent permitted by applicable law, PulseArc's aggregate liability is limited as set out in the applicable agreement. PulseArc is not liable for indirect, consequential, or incidental damages.

16. Healthcare disclaimer

PulseArc provides technology infrastructure and does not independently provide medical advice, diagnosis, treatment, prescriptions, or emergency healthcare services. See the Healthcare Disclaimer.

17. Suspension or termination

PulseArc may suspend or terminate access in the event of material breach, unlawful use, or non-payment, subject to the applicable agreement.

18. Governing law

These terms are governed by the laws of [insert approved governing jurisdiction] and disputes are subject to the courts of [insert approved venue].
