Terms and Conditions

These terms apply to this website and, alongside the applicable agreement, to any configured platform environment.

1. Provider identity

The website at pulsearc.online and the PulseArc platform are provided by Clicked IN FZE LLC, trading as PulseArc Health Technologies, of Business Center, Publishing City Free Zone, Sharjah, United Arab Emirates ("PulseArc").

2. Service scope

PulseArc provides configurable operational technology supporting administrative workflows for healthcare organisations. It does not provide medical advice, diagnosis, treatment, triage, clinical decision-making, emergency response, patient monitoring, prescription management, insurance processing or access to any government health system, and it is not a healthcare provider, insurer, payment institution, bank or merchant of record.

3. Website use

You may use this website for lawful information and enquiry purposes. Information on the website is descriptive, is not an offer, and does not create a contract. Diagrams and workflow overviews describe how the platform is configured for an agreed scope.

4. Enquiries

Enquiries are commercial discussions only. No obligation arises on either side until a written agreement is signed.

5. Implementation scope

Which modules are configured, which data sources are used, what training is provided and what support applies are all fixed in the applicable agreement. Nothing outside that agreed scope is provided or implied.

6. Account and user access

Access is limited to named users authorised by the customer organisation. The organisation nominates administrators, maintains its user list, and is responsible for credential security and for removing access when it is no longer appropriate.

7. Customer responsibilities

  • All clinical and patient-care decisions, and professional conduct of its staff.
  • Patient consent and the content and lawfulness of any communications sent.
  • The accuracy and lawfulness of information entered into the platform.
  • Its own regulatory, licensing and professional obligations.
  • Deciding and maintaining user permissions.

8. Data roles

The data-protection roles of each party, and the instructions PulseArc acts on, are set out in the data-processing terms agreed for that implementation. Those terms take precedence over any general description on this website.

9. Integration dependencies

Any integration depends on the third-party system, its owner's authorisation and its terms. PulseArc is not responsible for the availability, accuracy or performance of a third-party system, and no compatibility is implied until confirmed in writing.

10. Support boundaries

Support is provided through the documented route for platform faults and in-scope configuration changes. It does not extend to clinical questions, decisions about who should have access, the content a customer enters, or third-party systems.

11. Availability

PulseArc takes reasonable measures to keep a configured environment available. Maintenance, third-party dependencies and events outside its reasonable control may affect availability. No uptime figure is published on this website; any availability commitment must appear in the applicable agreement to apply.

12. Fees

Fees, billing arrangements and any taxes are set out in the applicable agreement. No payment is taken through this website, and no subscription is sold through it.

13. Intellectual property

The platform, its documentation and PulseArc branding remain the property of PulseArc. A customer receives a limited, non-transferable right of use for the term of its agreement.

14. Confidentiality

Each party protects the other's confidential information and uses it only for the purposes of the agreement.

15. Suspension and termination

Access may be suspended or terminated for material breach, unlawful use or non-payment, in accordance with the applicable agreement.

16. Liability

To the maximum extent permitted by law, PulseArc is not liable for clinical outcomes, care decisions, or the accuracy of information entered by a customer, and its aggregate liability is limited as set out in the applicable agreement.

17. Complaints

Complaints should be sent to management@pulsearc.online with the organisation name and a description of the issue. Complaints are acknowledged in writing and handled through the same route until closed.

18. Governing law

The governing law and dispute-resolution forum applicable to a customer engagement are stated in the applicable agreement, confirmed with qualified legal advisers for that engagement. No governing-law claim is made on this website in place of that agreement.
